Harley-Davidson Competition-Only Tuner Will No Longer Be Sold In The US

Recently, Harley-Davidson, Inc. reached a settlement with US Environmental Protection Agency (EPA) with regards to one of its products offered in the aftermarket. The company sold to US customers the Pro Super Tuner that can be used to calibrate motorcycles being used for off-road adventures and closed course competitions. Because of the sale of the product on the aftermarket, dealers and customers were able to tamper with motorcycles that are being used on public roads.
As part of the settlement with EPA, Harley-Davidson, Inc, has stopped the sale of competition-only tuners in the US; however, the company will continue to sell performance tuners that are designed to ensure that Harley-Davidson motorcycles will retain 50-state and EPA on-road emission compliance. Harley Davidson designed the aftermarket competition tuner to adapt engine parameters to the company’s aftermarket equipment. Although there was a settlement, it was not an admission of liability but a good faith compromise with EPA.
EPA has asserted that it is illegal for anyone to modify a certified vehicle even for off-road or closed circuit competition. Harley-Davidson has sold the product for more than decades under accepted regulatory approach that allowed the sale of competition parts only. It was legal to use the product in certain race conditions in the US. Competition-only products have been labeled accordingly with safeguards in place for dealers and customers regarding the effects of installing performance product on their Harley-Davidson motorcycles. By settling the matter with EPA, Harley-Davidson can focus its efforts towards product innovations.
